What about other aftermarket modifications and performance enhancements? Also they won’t pay more for extra’s, like spare rims and tires, tow hitch, ski racks, upgraded stereos. Also what if a fix is never approved?

I think they should be pretty generous if they are not getting totally screwed over. Running on Steelies instead of the aluminum rims, missing carpets, missing spare wheel and so on I think they will just ignore and pretend it never happen as the would like to do with whole Dieselgate. But missing body parts?

Might I suggest the addition of some theme music at the beginning and end of your show? Even the YouTube wannabes have something that clearly introduces their “show” and let’s us know when it’s over. Something other than, “uh, thanks, goodbye.”

Lehto is wrong though at 6:55)As an illegal car it cannot have a Clean Trade Value as it cannot be resold as it sits.

Anyways, hood/doors etc aren’t needed to pass inspection in many places.

Never got an offer and I turned mine in yesterday. I even hung out in the showroom while waiting for my appointment chatting with the sales guys. The person who processed my turn in did ask me if I was intending to replace it with a new VW, she said she understood why I went with a different brand.

I was not against staying if they pitched me a deal, then I drove the automatic golf wagon and hated it. It felt they had done nothing to improve it even though mine was the previous generation. The alltrack was intriguing but availability was a huge question.

I never received any offer or incentives from VW during the entire time so I don’t feel bad at all about taking the money and running.

The agreement specifically allows VW to repair any of the bought-back vehicles and put them back on the road if they want to (and if they have a fix). Which is one of the primary reasons that this agreement was not designed for consumers to strip the cars before turn-in.

Right and since the buyback includes two different generations one with and one without the def system. I wouldn’t be surprised to see the ones with the tanks back in the road t some point. As mine was an older one without the def system I took the settlement and turned mine in.

I’m guessing by Clean Trade Value they mean what it would be if the engine were emissions compliant.

The crux of his argument was that this agreement was put in place with the expectation that VW would fix, recondition, and resell as many of the TDIs that they can, so they expect to get cars back that, other than the cheat fix, can be easily reconditioned for sale.

There is absolutely no evidence that VW will do anything but crush them. That expectation is silly.

Again, VW is not in the business of converting diesel drivetrains to gas (or installing, tuning and retesting urea filtered systems) Zero possibility to defray any of the costs as lehto suggests.

To argue that assumption would be similar to the Simpson vs Wagon Sales LLC case, which closed with Simpson claiming, “If I had wheels, I’d be a wagon.”

I know logic has nothing to do with law, but this is straightforward.

It’s not just a filler word, though. He entered into a contract with VW to have his car repurchased and they could probably reasonably assert that he’s acting in bad faith (e.g. “spirit” of the buyback) given that he’s made public statements to the effect that he wanted to intentionally deprive VW of value. Bad faith is a pretty broad term, too, VW could make this plenty difficult for him if they feel so inclined even if he does ultimately get his car purchased.

The NADA thing was more to show that you can find any definition you want if you disregard context. The settlement clearly intends for VW to put the cars back on the road some day - so if you trash the car before returning it, you are no longer acting in the way the settlement was intended.

In response to the follow up video I posted (What to do after an accident) I got the usual stuff. My favorite: “EVERYTHING THIS GUY JUST SAID IS WRONG!”

And then a few hundred word screed going point by point over my video and disputing everything. Call 911? NEVER. Move the vehicles out of the road? ARE YOU INSANE. Get a copy of the police report? INSANITY!

What is truly fun is that about once a week I get a complaint from someone who says I am “censoring” them by not allowing comments to show without my approval. Yes, I am censoring. And if you can’t behave in a fairly civilzied manner you deserve it.
